These Terms and Conditions govern the use of Penfound Props’ website, services, and products. By placing an order, commissioning a prop, or purchasing merchandise from Penfound Props, you agree to the following terms.

1. About Penfound Props

Penfound Props is an independent prop-making business specialising in handcrafted props, costume accessories, and merchandise for cosplay, display, and personal use.

Penfound Props is not affiliated with, endorsed by, or sponsored by any third-party intellectual property (IP) holders, studios, publishers, or production companies.

2. Intellectual Property & Fan-Made Disclaimer

2.1 Unofficial Fan-Made Props

Any props, replicas, or items that may resemble existing intellectual properties (including but not limited to films, television series, games, comics, or books):

  • Are unofficial, fan-made items

  • Are created solely for cosplay, display, or personal use

  • Are not licensed products

  • Are not intended to infringe upon any trademarks or copyrights

All trademarks, character names, and copyrighted designs remain the property of their respective owners.

2.2 No Claim of Ownership

Penfound Props does not claim ownership over any third-party intellectual property that may be referenced or inspired by a commission.

Customers acknowledge that they are purchasing craftsmanship and materials only.

3. Custom Commissions

3.1 Nature of Commissions

  • All commissions are made to order

  • Each item is handcrafted and may contain minor variations

  • Commission timelines are estimates and not guaranteed

3.2 Commission Approval

By approving a design, quote, or progress update, the customer confirms they are satisfied to proceed.

3.3 No Refunds on Commissions

Due to their custom nature:

  • Commissioned items are non-refundable

  • Items cannot be resold due to custom fitting or specifications

Returns may be accepted for dissatisfaction, but refunds are not guaranteed (see Refund Policy).

4. Pricing & Payments

  • Prices are listed in the stated currency at checkout

  • Full or partial payment may be required before work begins

  • Prices may change prior to order confirmation

Penfound Props reserves the right to cancel any order if payment is not received.

5. Shipping & Delivery

Shipping times, costs, and responsibilities are outlined in the Shipping Policy.

Customers are responsible for:

  • Accurate shipping details

  • Customs duties, import taxes, and fees

Penfound Props is not responsible for delays caused by couriers, customs, or external factors.

6. Merchandise (Non-Custom Items)

Standard merchandise (such as T-shirts, hoodies, hats, and helmets):

  • Is subject to availability

  • May be fulfilled by third-party suppliers

  • Is eligible for returns and refunds as outlined in the Refund Policy

7. Use of Props

All props are intended for:

  • Cosplay

  • Display

  • Photography

Unless explicitly stated, props are not designed for combat, stunts, or hazardous activities.

Penfound Props is not liable for:

  • Injury

  • Damage

  • Misuse of products

8. Liability Disclaimer

To the fullest extent permitted by law:

  • Penfound Props shall not be liable for indirect or consequential damages

  • Liability is limited to the purchase price of the item

Customers assume all responsibility for the use and handling of props.

9. Right to Refuse Service

Penfound Props reserves the right to:

  • Refuse or cancel commissions

  • Decline requests that may infringe IP law or violate platform policies

  • Cancel orders due to abusive behaviour or unreasonable demands

10. Cease & Desist Compliance

In the event that Penfound Props receives a valid Cease & Desist notice:

  • Affected listings or commissions may be removed or cancelled

  • No further replicas of the disputed item will be produced

Penfound Props will comply with applicable legal requirements.

11. Changes to Terms

Penfound Props may update these Terms and Conditions at any time. Changes take effect immediately upon posting.

It is the customer’s responsibility to review the latest version before purchasing.

12. Governing Law

These Terms and Conditions are governed by the laws applicable in the business’s operating jurisdiction.
